Hi
I am going to appear for H1-B interview next month.
I was supposed to get my degree in 2000(Electronic Engineering) however due to backlogs and since I started job before degree completion I completed my degree in 2005.
Is that a real big problem?
Although I have double bachelors one in Electrical Engineering and other is science but my work evaluation is based on my bachelor of engineering degree.
Please help.

I believe as long as you have a degree certificate and 3+ years of work experience you should be fine.

drona, Edited my earlier post for clarity. I did not mean send flowers to president, I was refering to flowers sent to USCIS in the past. Hope the edit makes the point clearer.

Yesterday I got this e-mail from USCIS:
-----------------------------------------------------------------
Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Case Transfered to Another Office for Processing
we transferred this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our NATIONAL BENEFITS CENTER location for processing and sent you a notice explaining this action. Please follow the instructions provided on the notice. We will notify you by mail when a decision is made. If you move while this case is pending, call customer service at 1-800-375-5283 to update your address. You can use our processing dates to estimate when your case may be processed by following the link below. You can also receive automatic e-mail updates as we process your case by registering in the link below.
--------------------------------------------------------------------------
From what I read online, I am sure I will be called for an interview at my local USCIS office. But, my case has some issues and I was worried if that would create any problems
1. I was arrested for shop lifting in year 2000, which I have mentioned in I-485 application. It was a misdemeanor.
2. My LC application had salary mentioned of 85K, but my current job has salary of 75K
Do you guys think this could create a problem during the interview? I met my lawyer and he said the salary should not be an issue.
Do you suggest taking my lawyer to the interview?
Any help is appreciated.
Thanks.

You can live in US legally beyound your current H1B I-94.
As long as your AOS (I-485) is Pending, Ofcoure u need EAD for work.
Hello Friends,
I have utilized AC-21 and moved onto another employer and I will be using my EAD. I have an I-94, from the I-797 of my previous employer, which expires in May 2008.
The question I have is if we have utilized AC-21 can we still live here in US past the I-94 date? Will the stay be considered legal? I ask because as far as I know when a person is on H1B he can not afford to go past the I-94 validity date, does the same apply with an AOS applicant?

Saw it. However, if my experience with slashdot is anything to go by, we wont get any sympathy from fellow (US citizen/GC) techies there .. they have been brainwashed into believing that we actually stole their jobs ... in any case their opinion does not matter much. The only folks who count are the media and lawmakers.

I think you should talk to a good lawyer immidiately. Waiting here for someone to answer would jeopardise your relatives entry back into US later. As per the law they should be leaving US as soon as you get the denials.
good luck.

Are there any risk factors involved in changging the job by invoking AC21 ??
its not any more or less risker than someone who is not married or whose spouse has already filed 485 (ie. your special case makes no difference to your using AC-21): only thing to consider is: what visa is your wife on, if H4, then you must change jobs using H1. You will need to stay on H1 until your PD is current and your wife is able to file her 485.

Hi,
My pending I-140 (filed an year ago...June 2006) was transferred from TSC to NSC on 09/05/2007, because my I-485 was filed with NSC. What date willl NSC use as received date to process my case...the date they received from TSC or the original receipt date?

I believe your sister can apply for you int he 4th Family based category.
Below is the family based catgory, you can find this in any visa bulletin too.
FAMILY-SPONSORED PREFERENCES
First: Unmarried Sons and Daughters of Citizens: 23,400 plus any numbers not required for fourth preference.
Second: Spouses and Children, and Unmarried Sons and Daughters of Permanent
Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, and any unused first preference numbers:
A. Spouses and Children: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;
B. Unmarried Sons and Daughters (21 years of age or older): 23% of the overall second preference limitation.
Third: Married Sons and Daughters of Citizens: 23,400, plus any numbers not required by first and second preferences.
Fourth: Brothers and Sisters of Adult Citizens: 65,000, plus any numbers not required by first three preferences.
I am not very sure if dual application is possible.

My H1B was expired on DEC11,2009.My employer applied H1B extension in Oct 2009, i'm still waiting for Approval notice. since my I-94 expired on DEC11,2009. what is my status untill i get my H1b extension? will i be in leagal status until i get the H1 approval?
I have EAD with the same employer but not using.
Is anybody in the same situation?
thanks
Since you applied for extension before your current H1 expired, you are allowed to continue to work for 240 days from the date of H1 expiry. If your H1 is still not approved, then I believe you will have to stop working but can still be in the country till a decision has been made on your petition. Your employer could try and upgrade your pending application to premium processing so you will get to hear from USCIS within 15 days.

AR-11 form you send to different address . It is not part of I-485.
It is less likely that they compare your addresses with AR-11 address audit logs.
I think you should not worry too much about it.
Though you need to send AR-11 with in 10 days of your move to new address , I guess you can still send AR-11 form ,as AR-11 form does not ask from which date you moved to the new address. Check with your lawyer also

The G325A form contain the below text.
Applicant: Be sure to put your name and Alien Registration Number in the box outlined by heavy border below.
My lawyer mentioned that it is A# number. At present we dont need to fill anything.
Is it true?
If you have an A # you can enter it, if not then this should be self explanatory.
