I plan to probably file under the EB2 category soon- I know EB1 and EB2 can be filed separately, however can a EB2 regular and a EB2 with NIW application both be filed separately as well?

I'm going to Vancouver for H1B stamping next week along with my spouse. My understanding is that $150 is the application fee but I'm not sure if it is $150 for entire application (H1 + H4) or is it $300 ($150 for myself and $150 for my wife).
Can someone please clarify? and if I need to have separate Scotia bank receipts for myself and my wife?

What are the timelines for I-539 Change of Status for H1 to H4?
Is premium processing option available for the this change of status?
Friend worked till last week of pregnancy (clean H1 history before). Her 12 weeks of maternity leave is ending soon and looks like the family needs to pay attention to child's condition and she has no choice but to become a full-time mom (another full-time job in itself though). She was in status during her maternity leave (some part of which was covered by STD insurance, remaining unpaid leave totaling 12 weeks under FMLA). She needs to change her status from H1 to H4.

If it is by and large the same business, their immigration lawyer will have to file some paperwork indicating the company has changed its structure and for the paperwork to be amend under the new name.

Hi Gurus,
Thanks for your time on this post. I appreciate your responses.
I have a question regarding AP. I have AP's based on my pending 485. Recently i traveled to India (on a family emergency) using my AP which was issued in 20th Nov 2008 valid till 19th Nov 2009. I had no issues & got thru JFK using the same.
I was out of US from Sep 23rd thru Oct 24th 2009.
Before leaving US I applied for my AP in early Sep, which got approved by Sep 29 and was in my mail box by the time I arrived. The New pay roll has validity from 20 Nov 2009 until 19 Nov 2010.
My question is, I may need to travel to India again for couple of months that is some some time near 5 Nov 2009 & will be back by Jan 2010.
Do you guys foresee any other issues? , I herd that the AP is NOT valid if you are out of the country.

Hello,
My labor certification was filed in December '07 and is in the process of audit (Fragomen law firm issue). Meanwhile, there is news that my company is being sold off. Will I be able to continue my GC process if the company gets sold off but I am able to retain the same job and title.
Is anyone else facing a similar situation? What are my options here?

yes, they are right. if you try to file GC now then they will calculate your stay period and ask you to leave the country immediately (they wont even wait for july 2011). I think it makes sense to go out of country asap for one full year, come back with new H1 and then start the GC process. Alternatively if ur spouse is working and is on valid status then convert to H4. you can start ur GC process on H4 too. Once labor is approved activate your H1 and file for 7th-8th year extension.
im not a lawyer but my experience with immigration gives me the knowledge to suggest you the above. in such critical time its always worth to contact an immigration lawyer and seek advice.
