Actually you should consider yourself in the same group as these so called stupid people, cannot exclude yourself as a smart person just because you did not take an ARM. Any decent website/article/source of info will tell you that you cannot buy a house if you are planning on staying for less than 2 years.

Here is some real advice:
Letting your bank forclose on you or filing for bankruptcy is not a decision you take lightly asking people on the forum for advice. Your credit score can go down by as much as 300 points affecting you financially over the next few years which you perhaps have not really thought about. Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.

Can we apply two labors with different companies for single person in PERM ?
my labor is approved with B company in Aug2010.
my employer (company A - holding my h1) also applied labor in July2010.
they are called employer and want to visit company and consultant work place
USCIS visited wrong address and they mailed to my employer like below
1) If MR. is employed by your organization;
2) The start date of MR. employment with your organization;
3) The specific geographic location and physical address MRs working at;
4) The current client that MR is assigned to. Please also provide contact information for a representative of that end client and a copy of the contract. You also indicated that you have filed a new LCA with the Department of Labor � please provide a copy of that LCA.
5) The specific job duties that MR is performing;
6) And the current annual compensation of MR.. Please provide a copy of the IRS Form W-2 issued to MR for 2009 as well as recent payroll documentation for July 2010 to present.
I am working in Govt client,I can provide above all the documents except may not provide representative name and number.
how can i manage this situation,please give me suggestion and share your experiences.

However, if there is so much noise over immigration in general, then atleast there is hope of comprehensive immigration bill being considered by Senate which will lead to overall comprehensive legislation -- a vehicle that can carry legal immigration reform also.

I thought each EB category could get upto 28.6% of 140000 = 40000 visas every fiscal year. So if EB1 uses up 5000 and EB2 takes the remaining 35000 and its annual allotment of 40000, EB3 does not get any spillover.
Thoughts?

anyway, I understand the lawyers need to be paid! I just want them to stop changing the rules in the middle of the game. Its been a long frigging wait and now this.
My hope is that there was some misunderstanding and that they will just quietly remake the offer and give me the job back.
At will employment does not mean you can discriminate. Its akin to firing someone if they get pregnant or me leaving because I did not like the skin color of my boss. Both are discriminatory if they can be proven. In this case it can be.

I tried calling KCC and they denied to provide any information on PIMS.
My H1B was approved in Mar 2007 for 7th year extension. I also had my H1 transfer on May 2005.

USCIS has to work in FIFO process not RIRO(Random In Random Out)... So they can't send Receipt Notice to Aug 17th filer and then look for July 2nd filer. I sent my concern to congressmen?

I fully agree that USCIS should work FIFO, but "should" does not make that happen. Clearly USCIS is not equipped for FIFI when truck loads of applications arrive. We may complain now, but I believe we should give them additional 10 days they need (to make it 90 days). I am equally worried about my July 2 filing. Nevertheless, I wish and hope the congressman's intervention helps.

We are planning to make a trip to Hyderabad, India along with my wife and my little baby boy. After reading all of your experiences, I am not sure which one should I opt for. We have an expired Visa on passport, planning to Use AP. As we are travelling first time with the little baby boy, I am looking for some hassle free flying. I recently traveled to Chennai. My H1b visa was expired in my passport and have an approved AP. I traveled through AA (Frankfurt) --> Gulf Airways (Bahrain) --> Madras and ultimately to Tirupati by Car, While going to India no one cared to ask for any documents not even in Frankfurt. By the way if you don't know this, you don't need a TV for Germany if you have AP. While coming back (I just came 2 weeks back), the officer at the Immigration counter looked at my passport and asked me how can i travel to US with an expired US Visa. I didn't give him my AP with my passport coz I was lazy to take AP from my bag. Finally I showed him my AP and he let me in. Now all the officers in India know about AP. They wont be surprised looking at the AP. In Bahrain I had a lay over of about 13 hours. Gulf Air gave me hotel accommodation. At the Bahrain immigration counter, the officer flipped 2-3 pages in my passport and didn't even care to look at my visa/AP. In Frankfurt, while boarding the AA flight to Dallas, the lady at the AA counter verified all my documents even my office badge. If possible carry your office badge/ID card with you. If you don't have one it should be OK because you are not required to carry and you can always tell them that you are not carrying. Since I showed her my AP, she took all my documents including my badge to her supervisor for the approval and finally gave me the boarding pass. In DFW the immigration was like a piece of cake. I was the second person in the queue. CBP officer after taking my finger prints took me to an officer (Secondary Inspection). The officer at the Sec inspection verified all my documents in his system and asked me to show my EAD. After checking my EAD, he said its not mandatory to carry EAD but safe. The whole process took less than 15 minutes. Let me know if you have any other questions.

If it is not included then we need to take in to account that for every 485 application we will bare minimum have 1 spoude 485 application that requires VISA Number.

There are 37275 applications with PD of 2004 or earlier. Can we make an assumption that about 20 to 30% of these would try to port once economy turns around in the next 18 to 24 months? How will this impact wait time for a EB2 with PD Jan 2006?
I am really disappointed in the info provided via the foia effort. It told me that there are only 4118 applications before me. 4118 vs 28074. Worst kind of sick joke.
Based on the PD on my 140 Approval Notice (May-2004) there are 28074 applications before me. This is the correct date.
Based on the PD on my 485 Interview Notice (Aug-2007) there are 53192 applications before me.
I do not know how my application was counted when the data was put together.

The USCIS has yet to release the detailed progress report on the receipting delays in terms of the numbers that have yet to be processed for receipting. The only thing people know through various private websites just indicates that there are a plenty of people who are still waiting for filing fee checks cashed or receipt notices received for the cases which were filed as early as July 2, 2007, not to mention any later cases.
We reported earlier that the USCIS had allegedly received total of 800,000 cases for the July VB fiasco cases. There is an unconfirmed report that they have completed the receipting only half way through of the total, meaning approximately 400,000. There are no sources of information to verify or confirm the figures. However, if it is correct, the USCIS has yet to process mountains of receipting workloads ahead and the filers have some additional sleepless nights which they will have to endure for a while. AMEN!

These are very tough and partisian bills (immigration bills). This also being an election year, some lawmakers will try to puch their own agenda. Don't expect a featherbed solution. This will be a dogfight.
This time atleast there will be some democrats to vote for our bill, unless the anti guys find some way of preventing them from participating in it.

I went for H1B extn (approved Nov 2007) stamping on 15th Jan at New Delhi consulate. The person checking the papers at the outside window wrote - PIMS found on my appl form.
I checked with the VO after the interview if I will experience any PIMS delay. He replied he would not have been able to process my application without PIMS entry being found and everything is good.
Got the passport back on 18th.

The priority dates became current right before the immigration bill was to be brought up for the second time in the senate. Now as the bill has been shot down, next day these rumours begin surfacing. Guess no need to keep us distracted anymore, so no need to go through the pain of getting bombarded with applications.
I feel, both are extraordinarily extreme measures. Make priority dates jump 5 years in one month and then retrogress them in the middle of the month.
