    ok this is what I have
    a) email with offer of employment and link to I9 form in offer letter
    b) accepted verbally
    c) background check done and report sent to me
    d) called and was chatting when I mentioned EAD, was told sorry we cant offer you employment due to EAD, and that is has to EAD filed by this company only because they cant verify its legality et., one way was for them to do my h1b but they are not hiring h1b right now, so sorry. later they said they would consult with legal and get back to me. however i dont hold out much hope
    e) i immediately filled out the i9 form
    f) wrote email to them outlining our conversation from d) explaining my surprise (and boy! was a surprised!) and trying to make my case that I was not a risky bet for the company because of how interminably long I have been in this country and my spouse had GC already, but mine was not processed in time before priority date became not current.

    g) hr wrote back, acknowledging our conversation and saying that they were not sure and that is why they were going to consult with their legal dept and will talk next week.

    All I have are emails and offer letter.
    I really dont want to go the legal complaining route if this can be resolved. But I am in a fighting mode. I probably would not have been so upset if I had not turned down other interviews...

    I am sorry if I am wrong, but do you think if IV CORE try to hold a meeting with top CIS officials on this issue, wouldn't that be more effective? Many members reported not getting proper response to letters. Who knows whether anyone @CIS has time & willingness to read and act on our letters? Why not take an active approach rather than passive one?

    I agree, We still should send the letters though. I will send mine by monday Nov. 10. Meanwhile, if we can do the webfax or email, we may can have more members participate. just my 2 cents!

    So far not even 100 participants to the event. This lack of action is killing us. I sincerely thank people who sent mails.

    Can you please further explain how the visa flow will work if instead of horizontal flow it is made vertical flow... or you have some other interpretation?
    The idea here is to get USCIS to follow the law

    Yes, the old system will be restored. Please note that this is the only sure fire way of EB3-I going forward. There is some comments that EB3-I can really only benefit if EB2-I goes current with the current horizontal spill over rules. Such statements are clearly misleading. Eb3-I will not directly be impacted by EB2-I being current. It just allows EB3 to get a lot of numbers which will first be used by EB3-ROW before spilling over into EB3-I.


    With this change, we get EB3ROW move ahead faster, it probably would have been C had the rules been followed, and EB3 would have started moving ahead.

    The only way for EB3 to move ahead is for EB3-ROW to become current, nothing else will help EB3 beyond the visa recapture (which is iffy at best). If we get USCIS to follow rules, this happens sooner, and EB3-I starts to move sooner. If not, EB3-I shall wait for a long time.

    You must be kidding me if you cannot make out the difference between an approval and an RFE. It clearly states "Your Case Status: Decision"... What more do you want?

    Today I got one more email (See below) and my status changed from CPO to Decision. What does that mean? Did they send an RFE?

    Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

    Your Case Status: Decision

    On September 8, 2010, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice.     None of the memos have stated that AC 21 can be used only in the case of lay offs. It could be a case of USCIS covering up a mistake they did. With the severe retrogression and impending recession there could be several reasons an employee will leave the employer.

    One of the iv member, has stated that the I485 has been denied for his friend, upon withdrawl of 140 by his ex-employer. His ex-employer has informed USCIS, that the employee left the job on his own. Also, he quoted that "USCIS denied I485 because, ac21 can be used in case of layoffs only , not switching for jobs"

    In your letter you are requesting to give RFE/NOID before denial, but the fundamental reason for denial is different in the above case. what is use of getting RFE/NOID, in that case?

    AMY GOODMAN: Our guest for the hour is Lou Dobbs, well known as the CNN anchor of Lou Dobbs Tonight. In May, the New York Times published a critical article about you, Lou.

    AMY GOODMAN: It was called �Truth, Fiction and Lou Dobbs.� Columnist David Leonhardt wrote, �Mr. Dobbs has a somewhat flexible relationship with reality.� Leonhardt highlighted this profile about you that aired on CBS�s 60 Minutes.

    LESLEY STAHL: One of the issues he tackles relentlessly is illegal immigration. And on that, his critics say his advocacy can get in the way of the facts.

    LOU DOBBS: Tuberculosis, leprosy, malaria?

    LESLEY STAHL: Following a report on illegals carrying diseases into the US, one of the correspondents on his show, Christine Romans, told Dobbs that there had been 7,000 cases of leprosy in the US in the past three years.

    CHRISTINE ROMANS: Leprosy, in this country

    LOU DOBBS: Incredible.

    LESLEY STAHL: We checked that and found a report issued by the US Department of Health and Human Services saying 7,000 is the number of leprosy cases over the last thirty years, not the past three, and nobody knows how many of those cases involve illegal immigrants.

    [interviewing Dobbs] Now, went to try and check that number, 7,000�we can�t. Just so you know�

    LOU DOBBS: I can tell you this: if we reported it, it�s a fact.

    LESLEY STAHL: You can�t tell me that. You did report it�

    LOU DOBBS: No, I just did.

    LESLEY STAHL: How can you guarantee that to me?

    LOU DOBBS: Because I�m the managing editor, and that�s the way we do business. We don�t make up numbers, Lesley, do we?

    AMY GOODMAN: A day after the 60 Minutes report aired, Lou Dobbs discussed the issue on his program with his reporter, the CNN reporter Christine Romans.

    LOU DOBBS: Then there was a question about some of your comments, Christine, following one of your reports. I told Lesley Stahl we don�t make up numbers, and I will tell everybody here again tonight, I stand 100% behind what you said.

    CHRISTINE ROMANS: That�s right, Lou. We don�t make up numbers here. This is what we reported. We reported: �It�s interesting, because the woman in our piece told us that there were about 900 cases of leprosy for forty years. There have been 7,000 in the past three years. Leprosy, in this country.� I was quoting Dr. Madeleine Cosman, a respected medical lawyer and medical historian. Writing in The Journal of American Physicians and Surgeons, she said: �Hansen�s disease��that�s the other modern name, I guess, for leprosy��Hansen�s disease was so rare in America that in forty years only 900 people were afflicted. Suddenly, in the past three years America has more than 7,000 cases of leprosy,� Lou.

    LOU DOBBS: It�s remarkable that this�whatever, confusion or confoundment over 7,000 cases. They actually keep a registry of cases of leprosy. And the fact that it rose was because of�one assumes, because we don�t know for sure�but two basic influences: unscreened illegal immigrants coming into this country, primarily from South Asia, and the�secondly, far better reporting.

    CHRISTINE ROMANS: That�s what Dr. Cosman told us, Lou.

    LOU DOBBS: And, you know, in talking with a number of people, it�s also very clear no one knows, but nearly everyone suspects, there are far more cases of that. It is also, I think, interesting, and I think important to say, one of the reasons we screen people coming into this country is to deal with communicable diseases like leprosy, tuberculosis. The fact is, if we would just screen successfully, all of those diseases can be treated effectively, efficiently and relatively quickly.

    AMY GOODMAN: That�s Lou Dobbs on the show. The source behind the claim that there was a spike of 7,000 new cases of leprosy was a controversial medical attorney named Madeleine Cosman. In 2005, she described undocumented immigrants as �deadly time bombs, because of the diseases they bring into the country.� Cosman, who died last year, has also been criticized for these comments she made about Mexican men.

    MADELEINE COSMAN: Recognize that most of these bastards molest girls under age twelve, some as young as age five, others age three. Although, of course, some specialize in boys, some specialize in nuns, some are exceedingly versatile and rape little girls age eleven and women up to age seventy-nine.

    What is important here is the psychiatric defenses: Why do they do what they do? They do not need a jail; they need a hospital. They are depraved because they were deprived in their home country. But more important is the cultural defense: they suffer from psychiatric cognitive disjuncture, for what does a poor man do if in his home country of Mexico in his jurisdiction if rape is ranked lower than cow stealing? Of course, he will not know how to behave here in strange America. This is thoroughly reprehensible.

    AMY GOODMAN: Madeleine Cosman, that�s her quote. She actually is not a medical doctor. She�s a Renaissance author and scholar of sorts. Lou Dobbs?

    LOU DOBBS: What would you have me say, Amy? Because what�the reality is what you don�t say, is that Leonhardt�s piece was filled with errors. Secondly, Madeleine Cosman, as we learned following that report in Physicians and Surgeons, the publication, is precisely what you styled her: she is a wack�or was a wackjob. But the New York Times didn�t know that, either. If you would read the obituary for Madeleine Cosman in the New York Times�have you done that, by the way? She died a year ago, which was, by the way, a year after we had used her as a source in a report, along with other people. Did you read that obituary? Did you find that the New York Times had come to basically the same conclusion we had, that she was a credible source? Because if you read that obituary, it is glowing and filled with plaudits for Madeleine Cosman. And so�

    JUAN GONZALEZ: Well, but, Lou, I think the issue�

    LOU DOBBS: But I must�no, no. I am going to say this�

    JUAN GONZALEZ: The issue is that we, as journalists�

    LOU DOBBS: To go through a body of

    JUAN GONZALEZ: �all have our own responsibility to�

    LOU DOBBS: No, listen to me, Juan�

    LOU DOBBS: �because at least we can have some civility�

    LOU DOBBS: �to go through this and try to convey that this is a body of work. I spoke for eight seconds after that report on tuberculosis and the screening of illegal immigrants into this country. For eight seconds. And you�re trying to project this as if it is reflective of a body of work. And that, I think, is�I think�

    JUAN GONZALEZ: No, but, Lou, the issue�

    LOU DOBBS: I would hope that you would be embarrassed by that.

    JUAN GONZALEZ: No, Lou, the issue is�

    AMY GOODMAN: You�re the managing director of your show�

    LOU DOBBS: I am the managing director.

    AMY GOODMAN: �and editor of your show.

    LOU DOBBS: And let me ask you a question: how many�how many people are on the registry for Hansen�s disease in this country?

    JUAN GONZALEZ: 7,000, total.

    LOU DOBBS: It�s over 7,000, correct.

    AMY GOODMAN: For thirty years.

    JUAN GONZALEZ: For thirty years.

    LOU DOBBS: Absolutely.

    AMY GOODMAN: You said over the last three years because of illegal immigration.

    LOU DOBBS: And what did we say? Did I say because of illegal immigration?

    AMY GOODMAN: Yes.

    LOU DOBBS: I said no one knows, but one assumes primarily, because they�re not being screened. That�s what the doctors at the Hansen centers were telling us. Secondly, the issue of�if you want to, I mean, explode eight seconds into a whole body of discussion, fine. The reality is, I think you would agree, that if we were screening illegal immigrants, as well as legal immigrants, we would probably have a heck of a lot less in the way of tuberculosis in this country, and Hansen�s disease.

    JUAN GONZALEZ: OK, Lou, I�d like to get into�take this in a much deeper perspective than just the particular fact�

    LOU DOBBS: I hope so.

That person would be the customer rep of this company and other company as a contractor (not even an employee). So telling the chat lady will not do anything. She will just log her time and bill the company for chatting with you. You need to contact the senior executives of the company

    what you said is quite possible; though the person seem to be aware of vonage deal and was little worried of possible impact on teleblend's business. (They have $49.99 unlimited India plan - simply doesn't make any sense now...) I am calling them now, Again. Usually teleblend offers good quality services at lower price than vonage or lingo. If they don't come up with a good solution, I will move to vonage by this weekend.

    I have a feeling that the IO might look at the applications received on Aug 17, 2007, only at last. Its because, when I went for infopass, the IO said that, "You have filed on the last date, so you will have to wait".
    Anyhow, I have tried all that I could, and now I leave it to the Almighty.

    Thats a good suggestion. I will contact the congressman and senator and ombudsman as well.

    How can they reopen a case thats already approved. They approved and reopened the case on the same day.

    We took infopass and they told us that the visa's retrogressed so they had to pull back their decision. I showed the officier visa bulletin and told him that am current as today is oct 1st and the new qouta should have started already.

    The response he gave is he cann't access the files as the files are frozen and it will take them about 2weeks to access the files.

    My files are at local office as i had an interview on Aug 24th

    Congrats ski_dude12. My personal opinion is that this may have delayed your greencard since July. Sometimes people get too anxious once their date is current and want to try everything that is possible to get approval. There is so much information and misinformation on forums.

    i would think that you dont need to raise any SR or other action for at least 3-4 weeks from the month your PD is current.

    i didnt do anything and the emails came to me by 7th of Sept
    maybe in some cases it helps, in some cases i heard- there have been delays

    Something is screwed up.....

    Mexico has over 2000 cases in April 2001 yet its PD is May 1st 2001
    India has less 500 cases in April 2001 yet its PD is Apr 15 2001
    This along with CIS giving "bad/incorrect" data to IV is indication of someone's malicious intentions.

    I appreciate IV's effort in getting FOIA executed and now working on aftermath of it.

    For people who are angered with whats been going on in last couple of days. All I can say is to try volunteering for IV even for a month.

    It call for filling status info for ALL NON NATIVE BORN US CITIZENS

    It provides 4 options ( abcd) & none of the option is applicable for 485 filers as in each case it either asks for derived citizenship or admitted permanent residents .

    I hope ther is some other form

    Can you all check this issue & find out the catch ?

    There are a lot of interpretations. Popular Attorneys like Rajiv Khanna and Sheela Murthy claim it is not valid and always advise clients to have a h1b backup. Not sure why they are so keen on h1b. It could be because some adjudicators may send EAD revocations also along with 485 denials.

    Chandu, they may have other good reasons to do so, but one advantage for attorneys is an added fees out of filling for H1B; and for employers is less employee turnover due to the fact that even if employee is willing to change jobs. It is not so easy to find next job with H1 sponsorship than to be able to find one on EAD :)

    If USCIS wants to do bad regulations, they will do it - with or without IV campaign for reform. What is the gaurantee that Michael Aytes will not issue a memo tommorrow restricting job movements further? They always keep doing that every now and then, on their own.

    Given the current volume of changes 350,000 apps, regulations are bound to change, one way or another. Whether you want it or not. If USCIS officers (not the top brass) feel overburdened with EAD/AP work they'll start issuing more, and more, random RFEs, NOIDs etc. to reduce their burden ( passing the burden to you). They also might introduce labor market and other restrictions to reduce the backlog by eliminating all AC21 users. What is stopping them from doing it on their own?

    Evading activity under the pretext of imaginary fears will not stop USCIS tommorrow if they decide to pass tough regulations. By requesting the 'right' changes, we are making sure 'wrong' changes don't happen. For that to happen we need to get involved in the decision-making process and influence the decisions in the right direction.

    Agreed. Positive intervention is always better.

    Lufthansa is another option for no transit visa, cheaper ticket than NW, Emirates or Singapore airlnies, little bit security check at Frankfurt when returning .....

    with emirates, there is a route via dubai (no torture) and one via hamburg + Dubai. I traveled via the second one twice on emergencies. you are ushered in a square box of a building with barbed wires and armed (fully armed and body armored, hand gunned, you-mongrel-looking) guards. There is even a special
    barbed wire line for 'special immigrant' (read asylum or illegal migrants) inside though i have not seen it used. then comes double wammy security checks (show-me-your-baby'smilk-is-edible type). There is one bathroom for each gender that has useless (over 10 months)faucets and one bar (no shop for food). the layover reminded me of concentration camps. But it was still better than $274 ;-)
