Can we ask for a new legislation that will allow for complete portabilty after i-140 approval? If this is achieved I don't think retrogression/insufficient Visa#'s would be a big deal.

I had to withdraw my application since I had to file for a divorce. I was just told yesterday that my petition in withdrawn and my wife will be notified in a week. I was also told that I can re-file before.
Currently we have withdrawn the Divorce papers as well. But I don't know what steps to be taken for re-file.
She has an A number which I can provide now. But the two question I have is her current USCIS status? She came on K1 and another question is "Have you ever applied for Perm. Res.?" The Answer will be yes with date and place of filing, but what should I write for final disposition.
Please help this is urgent.

I was in Canada and came back to US last weekend using AP. I only had two documents. They asked for three but I told them that I only have two and that is all I got from USCIS.
They made me wait for 15 minutes and then stamped both AP documents and gave it back to me with an I 94 and entry date/stamp.
I believe you should have your Advance Parole document and not with the immigration.

Just wait a few more days and you will receive his I-485 receipt. Some members received online rejection only to find later on that they have been issued a receipt notice.

On July 1, 2010, the Vital Statistics Office of the Commonwealth of Puerto Rico began issuing new, more secure Puerto Rican birth certificates to US Citizens born in Puerto Rico. As of October 1, 2010, all certified copies of Puerto Rican birth certificates issued prior to July 1, 2010, will no longer be valid. Accordingly, the Citizenship and Immigration Services (USCIS) issued a press release providing guidance to US employers with regard to the I-9 process. For new employees, employers may continue to accept all Puerto Rican birth certificates through September 30, 2010; after that date, only the new Puerto Rican birth certificates (issued on or after July 1, 2010) we be acceptable for I-9 purposes. Therefore, as of October 1, 2010, employers must pay close attention to the issuance date of Puerto Rican birth certificates presented for I-9 purposes.
For existing employees, there is no need to re-verify the employment authorization of employees who previously presented pre-July 1, 2010, Puerto Rican birth certificates. Federal Contractors subject to the Federal Acquisition Regulation E-Verify clause may continue to accept all Puerto Rican birth certificates prior to October 1, 2010, but beginning on that date, only the new Puerto Rican birth certificates issued on or after July 1, 2010, will be acceptable. Federal Contractors may not ask for the newer version during I-9 reverification of those individuals who previously presented the older version of the Puerto Rican birth certificates.

Whichever status was approved the LATEST, that is the status you are in now. If H-1B status change was approved AFTER F-1 status was granted, then normally you are on H-1B status.

Hello,
I filed 485 in July 2007 and got the 485 receipt nos for myself and wife and my daughter. Both my wife and myself got EADs too. Though i applied EAD for my daughter [who is under 4 years at the time of application], i neither received EAD reciept nor the application back. I saw in some other threads that kids under 10years are not getting EADs. Is it true?
I know some may ask why we need EADs for kids? My daughter 's I-94 is expired on Oct 10th 2007 and i applied EAD for her in july just in case though she cant work.
Any ideas?

I can't say which is right, but I can share my information (so far). My EAD was supposedly sent Sept. 5th. On Oct. 4th when I had not received it, I called USCIS and spoke to CSR, who put in a request for a resend of the card. I still have not received it, so after 45 days (the requested wait this time) I called again today. I have another service request number now and am told to wait another 45 days... At least the CSR admited she didn't think anything was done after I called in October! I wonder how many "45 days" they want me to wait!

I am working in company 'A' on H1B, Green card is processing from company 'B' as future employee. Got EAD.
The job is getting over from Company 'A'.
Can I use my EAD and can stay in US with out working to any company?
Will there be any issues if TAX is not paid when I am not working.
If i work part time then on do I need to work for company 'B' only?

You are good till the end of your original H1 regardless of the outcome of the extension... the catch is, you have to maintain H1 status.. meaning get paid, no benching etc.,

I am planning to use AC21 by joining a company on this March month end , I asked new company to process H1, and its in progress.
In APRIL Visa Billiton my PD is current, as I have PD of JUNE 2001( EB2), my RD - JUNE 29, 2007 .at this stage if I change company what is the impact on my GC approval. Should I wait for some more time to join the new company?

I have renewed my DL in VA while my H1B was pending last year (Oct 07) . All you need is your H1-B application receipt and they will extend it by 1 Year.

Whether it is Department of Homeland Security (DHS) policy or not, I do not know, but last week, I noticed DHS personnel roaming through the terminals at Dulles International Airport in Washington, DC. They actually went to various gates and randomly requested ID or passports from OUTBOUND passengers seated in the boarding areas.
That is, they checked the documents of both Americans and foreigners who were LEAVING the USA. Not entering.
I followed them around a little bit. The officers were friendly, civil. They approached passengers in the terminal, asked them their final destinations, and asked if they could see their passports. Interestingly, although I was standing right next to a bank of chairs in the boarding area, they did not ask me for my passport, nor did they ask anyone who was standing or walking through the terminal. They only approached persons seated in the departure gate area. I did not see them detain anyone.
I have often been asked whether DHS personnel made random checks of persons in airports. I used to say that "they could, but I've never seen it." Well, I have now. --jcf

My attorney has asked to send color copies of the driver's license for 485 filing. I just now realized that I have not changed my address on the license. Will that be a problem? Is it critical to have current address on the license? Any thoughts?
Yes, It is critical to have the current address in the DL. From your ID, friend_in_NC looks like you are from North Carolina. You need not go the DMV to change the address, can get it done over the internet and your new DL will be mailed within a week. Copy of DL is used only for EAD, you can file EAD after a week. Also state rule require you have the current address in DL. If you moved you have to get this done within 60 days.
