Thank for bringing that up.. I had the same inkling, of course , w/o anything to subtantiate when I first saw these "inventory" figures.. I had also posted couple of times this poser.. esp those who were in the math crunching mode to determine the D-days baed on our PD..
This makes such a huuge difference to the queueu.. I am reminded of a post who said he starts the day happy when he sees such numbers and ends with kicking his dog... Gosh I need a dog!!!!

OK, DOS buffer issue.
A. LAW. If there is no inventory in EB2 I/C (meaning demand). Theoretically DOS should make EB2 I/C CURRENT. DOS/CIS are not that dumb, or at least as dumb as before. I would say, they are very competent now and we should appreciate their work, pre-adjudicate, publish demand data (DOS), inventory data (CIS) processing time (DOS). THEY know, from PERM, I-140, there are at least 2K demand permonth from EB2 I/C. SO they will just safely move a couple of month of PD to make sure there is demand >2800 for India/China, so they don't have to make it CURRENT (per law)
B. LOGISTICS. There could be denials, RFEs, although most (I believe almost all 100% pre-07/2007 EB2 I/C) should be pre-adjudicated now (THANK DOS CIS specifically did this so no processing time, and no waster numbers hopefully). That is why DOS has to consider that in their demand, and CIS has to consider that in inventory numbers
C TIMING. Charles is shooting a moving target as well (his job is not easy as he cannot predicate future 100% and has to follow law, and use all visa numbers, we should appreciate that). Charles has no control on CIS number accuracy (I am sure CIS is trying hard as well), how fast EB1/EB2ROW/EB2I-c pre-072007 could come in, hey even some CIS employees need vacation in summer. So he has to make sure things can be done before August, so August could be only a month for fine tuning, not massive approvals, new applications (CIS wont look at them any way but takes man power), to use up all numbers and have some new applicants to keep the inventory (demand) at decent level.

Also, remember there will be new monthly quota getting allocated to all categories. So to use those numbers should they not be progressing dates?

My lawyer said u cannot have 2 485 petitions with USCIS.
My Lawyer's response - You should be aware that you cannot file two I-485 applications. If you file individually, there is no option to file as a dependent UNLESS the pending I-485 is withdrawn.

NO Matter how many people say "Take it easy" its simply not possible, you will have to be a superhuman to do that. Sure its stressfull but no more stressful than boarding your first flight to USA. no more stressful than attending 1st H1B interview at the consulate or your first client interview. So in the end, we have been through all the hurdles with most of us surviving 2001-2002 job markets and now is 2007.
The point is we have been through all that successfully and thats a BIG WIN. So we will be through this too, but not without stress. The day we decided to come to USA and until now we have been successful as we are resourceful and can improvise at a short notice and we will. We are shrewd individuals and We Will PREVAIL.

I still would not put the blame on the lender. Nobody put a gun to your head and asked you to buy a home. You, out of your own volition, went to the lender after all the shopping you did for rates, then settled with one lender and signed the contract. Why is it the lender's fault for lending you money when you needed it? Why didnt you finanance the whole purchase yourself? You didn't have that kind of money, right? So what the lender did was charge you interest, as a fee for loaning you the money. So the builder/owner of the home got his money from the bank and left. Now the two parties involved are you and the lender. And it is your obligation to pay the loan whether the home appreciates or depriciates. Like Canadian_Dream already said, any investment has risk associated with it. You should have paid attention to it before signing the contract. Have you ever invested in a stocks or mutual funds? There is always a disclaimer that there is a certain amount of risk involved. The investment in real estate is just like that. It is not like putting away money in a savings account which is insured by FDIC.
If someone is dumb enough not to know these things he should not be investing in the first place!

My wife got the approval on Oct 5th...CPO mail was first followed by approval notice and I also got a CPO mail after 35 days of approval....strange and surreal it seems

I may be wrong since my wife's case was separated.....But this was from my congressman's office who told me that the reason that her case is pending and delayed is because our case got separated during adjudication.

somebody with skills in finding out stuff should research on how much money per year is contributed by the working h1b employees and given the numbers that are sent back how much is actually "stolen" from them. I once again say "stolen" from them. If they are sent back they should atleast be entitled to all the money that was "ilegally" taken from them.

However, in this particular discussion - I guess it will help us all if we could keep the hectoring and general negative rhetoric out of it. Calling someone anti-immigrant in a derogatory fashion because he is opposed to our views - is negative rhetoric. So is the comparison of L1 abuse with house burglary.
The lawyers are taught the "Socratic Method" (http://en.wikipedia.org/wiki/Socratic_method) - to chafe out logic from the thicket of rhetoric. This is specially important when we are discussing something from different positions.

You will be considered a PR the day your I-485 was approved. In my case, I am not sure where they got the 2008 date. Most likely it is a data entry error.
Based on my conversation with USCIS customer service, when I return to US, at POE the officer will definitely notice the discrepancy that my I-485 was approved on 09/20 but the card says something else. This might lead to further questions... Better to avoid all this and get it corrected.
It could also lead to issues during citizenship as I am aware of the error. Best is to get a replacement card with correct details. It is surely a hassle considering the 3-4 months wait time, but the right thing to do.

I am EB2-I with a couple of US grad degrees (and same undergrad school as Rolling Flood, not that it matters to anyone except perhaps those who suppor the lawsuit). And I think this lawsuit is a bad idea because it is divisive and petty.
There is an old Malayalam story that most people who went to school in Kerala would have read in their primary school classes. Two guys, Greedy and Jealous, pray to God. God appears and Greedy goes, "I just want double of what you give the other guy. All I want to be is to be ahead of him." Hearing this, Jealous says, "God, please make me blind in one eye."
This lawsuit, like the story above, is a case of knifing others in the back, for no real gain. We should instead try to leverage IV's large membership for a common good, which is what has made IV successful so far.

He work at client place and client is administered project.The s/w tool is copyright by client.The reason for asking him to come back is that prior to this company he worked for another company for two years. He left his old company before 5 year. when he joined his current company he has provided all the document mentioned in checklist such as offer letter, exp and releiving letter and last two month pay stub and they did BG for same document.During 5 years career he worked for diff client and everytime they did BG for him before putting him in project and there was no problem happen in his BG. recently his current employer find something wrong about his prior company and they asked him to provide more evidance for prior company.now he don't have any contact of his prior employer and he does not have any more evidnace for showing their company.
Because of this reason they are asking him to come back home country from last two week.He told his company that he tryed to connect his prior employer but he can not make out and he don't have anything more to show the company.
Please suggest what he can do in this situation.

Did anyone see any Soft LUDs on their 485 or old EADs before their approvals/RFEs?
My PD is June 7 2006, not current. Yesterday, I had a soft LUD on my 485 and my first EAD. These two haven't seen any activity since early 2009, and I'm wondering if this means anything or if I'm reading into this a little too much.
