We had our interview on January 17th in chennai Consulate. Interview was smooth - which company.. how long you were working for the company and what do you do there.. these were the questions. We were told at the end that we will receive passports within a week.
So far We ( H1B extension -- 3rd time and my wife - H4( 2nd Time), have not received the passports. I already postponed our date of travel to Feb 5th. Looks like I have to postpone again.
Frustated..
Calling VFS daily to hear the same news.. Passports not been handed over VFS. The VISA is still under process.
Called Consulate Twice ... they say they are doing security checks..
for how long???
Vamsi
Hi, Vamsi, All,
I just called the Consulate for the umpteenth time in 4 weeks. The lady was very rude, and did not even listen to my questions. Here is how it went:
Her: Consular Section
Me: Good Afternoon madam.
Her: Hmm.
Me: I want to know the procedure to withdraw a visa application.
Her: You can send an email to us, stating that you need to withdraw the application, stating I-797 details.
Me: Ok. Do I need to submit anything else with the email?
Her: You need to submit a copy of the I-797 and a letter signed in original by you.
Me: But how can I sign the email?
Her: You cannot just email. We need original signed letter in courier. (note she said email before).
Me: And how much time does it take for the passports to return once you receive that letter?
Her: 3-4 business days. Ok. (she is about to hang up).
Me: (In a hurry) Madam I had one more question for you. Would you be able to track my passport also? It has been over a month since the visa interview, and we are still waiting for the passports.
Her: It is (couldnt hear) PIMS (couldnt hear).
Me: So has it been processed already, or is it in PIMS processing still?
Her: It is in PIMS. (wow, what a short answer).
Me: Can you tell me where is it stuck? May be I can get help from the company lawyer?
Her: Sir, you have to wait for the administrative processing to finish. I cant give you any specific details as to what is going on. You just have to wait. If you dont want to wait, you can withdraw the application. (she hangs up. Thats right, she hung up like this!)
My company lawyer suggests that I withdraw the application, and use the AP to get back. Now I am not sure if they will return the passports faster than they will stamp them. What a mess!!!!
Help dear God!

You seem pretty confident about getting an RFE. Did you already see the online status changed and just waiting for it to arrive in the mail OR is this pure guess work?
The reason I ask is because I am also in the middle of changing jobs and so have the same concern but not very confident of receiving one.
My priority date is current since september 2010.
My H1B transfer application is with USCIS since Aug 27th, 2010. The date for transfer requested is Novemebr 1st, 2010.
My I 485 was filed in Aug 2008. I have been working with the current sponsoring employer since 2005, no breaks.
I am expecting an RFE for my I 485. Anyone who was in similar situation share what kind of RFE is likely to be issued? I already have a job letter from the new employer essentially stating same kind of work duties.
Thanks.
PS: Also, how do you start a new thread on IV?

It is rather unfortunate that people on consular process track despite the fact that they have approved I-140, yet they couldn't be allocated visa while other people on adjustment process could file their I-485 when everybody PD became current. don't you think it is rather unfortunate.
Any hope for consular processing? with the situation.

Let it be 5000 min/pm. Still, 5000 min/month give about 2.7 hours per day. Talking 2.7 hours to India per 24 hours is unusual for many. I don't even get 30 minutes to talk. Even if we want to talk 2.7 hours you will be distrbing people in India, as they may be watching cricket or Tv serials.:)
Any way, this pan is simply superb compare to the situation before 10 years. Compare to many phone providers/cable compaines, vonage customer service is simply great, at least in my experience.
only down side of free 2.7 hrs/day is that the in-laws would now expect more calls from their US son in laws:) IV could you please hide this discussion from the inlaws in india?

senthil1 is one of those who is "shut the door behind you" kinds folks. He has been consistent on his stand and he wants to side anti immigrants. He is a disgrace and shame to your community. I had a feeling that sometime back he was 'reformed criminal" but does not seem so anymore.
I have been watching his postings for sometime now and his messages closely matche with the antis. He may be working for the losers guild or a hira in the making. Unfortunate.

I have read it in Ron Gotcher's forum that what Sept bulletin talked about was only for Mexico and people should not mix it with EB-3 India. Also Apr'2001 was the PD given to the asylum(245i) cases by the Clinton administration. But with dates moving to Nov'2001 I believe that hump have gone past. My personal belief is EB-3 India should go around Jun-2002. But In case it remains in 2001, EB-3 Indians should take some drastic decisions. You may call me pessimist but I don't see any help coming from the congress, rather there could be some weird irrational decisions which could leave us paralysed. There are more foes than friends in the congress and lawmakers do what there pupil tells them to do. Right now the under current in US is anti immigrant..
Here's a quote from the Sept Visa bulletin http://travel.state.gov/visa/frvi/bulletin/bulletin_4328.html
June cutoff for EB3-I was Nov 2001. So worse than this means, the cutoff will be eariler than Nov 2001. And I picked Apr 2001 as the lower bound just because, Apr 2001 is a very well known time frame where the PDs just hung there forever for EB3....dig around in the forums to know more about Apr 2001 and its relation to EB3, backlogs, etc....

Hi All,
Its been astonishing journey, came to US in 2000 June, saw downfall of .coms followed by Housing bubble burst, than 911 , than Economical challenges, Job losses, etc.... the irony list are/were endless. Hope of GC was next to impossible.
Following were the steps to miracle :
- Filed Labor in 2005 Dec, got denied due to lawyers mistake:mad:
- Refiled the same application and Got approved in March 2006:D
- Applied I-140, paid extra for premium but it took more than 4 months to approve.
- Fight with employer, left company overnite, guess when ?(2 weeks before July Fiasco )
- Refilled labor in Jan 2008, Got approved in March 2008
- RFE on previously approved I-140
- Convinced lawyers to file application for I-140 , requesting PD recapturing.
- Got I-140 Approval in Aug 2008
- Filed I-485 in Aug 2008
- FP in Oct 2008
- RFE in Aug 2009
- Contacted Congressman, it was helpful as got to know the exact situation.
- Took infopass 2 times
- Not sure if this helped or not but called 1-800 number and spoke with level 2 officer and she hinted that I may not have to wait that long ?
- Approval in Sep 2010
Thanks to IV, it was immensely helpful.

I Have opened an SR on Aug 6th and then sent an email to TSC followup . I got a response from them on friday " We are currently researching this situation and will contact you with an update." HAs anybody this kind of response?
Thank you
I had created two different SRs, one for myself and kids and one for my wife. The SR which I created for my wife got a response with Card Production Ordered and for the SR I created for myself, the status in the response was "currently under the review". The date was one day before my CPO mail date.
I guess you have nothing to worry. This seems to me as a standard response.

Wow.. Applicants are waiting since 2002 and Govt Agency know it but don't do anything. Shame on you FBI NNCP
Check this:
http://www.bibdaily.com/pdfs/Liang%2010-30-07.pdf
Defendants assert that the background check is a complex
process that must accommodate an extremely large volume of requests
from the USCIS. Given the backlog of name-check requests and the
FBIs limited resources, they maintain that the delay of two and a
half years in processing Mr. Liangs background check is not
unreasonable. There is some validity to these points, and the
Court appreciates that the name-check process is indeed complex and
resource-intensive. But limited resources or not, a common-sense
rule of reason dictates that if the FBI was performing background
checks with due diligence, it would not take two and a half years
to process Mr. Liangs name. While the Court is sympathetic to the
demands placed on the FBI and the limited ability of the USCIS to
control how the FBI allocates its resources, a lack of sufficient
resources devoted to name-check operations is a matter for the
agencies to take up between themselves or with Congress. The
executive branch must decide for itself how best to meet its
statutory duties; this Court can only decide whether or not those
duties have been met.
See Dong, 2007 WL 2601107 at *11 ([I]t is
not the place of the judicial branch to weigh a plaintiffs clear
right to administrative action against the agencys burdens in
complying.).
Moreover, although there is no Congressionally mandated
timetable for the processing of I-485 applications, Congress has by
statute expressed its view of what a reasonable amount of time is:
It is the sense of Congress that the processing of an immigration benefit application should be completed not later than 180 days
after the initial filing of the application. 8 U.S.C. 1571.
The Court recognizes that this statute was enacted prior to the
events of September 11, 2001, and that the burdens on agencies with
responsibility for immigration matters have since increased.
Nonetheless, Plaintiffs applications have been pending for five
times the length of the period identified by Congress.
Defendants argue that expediting Mr. Liangs name check will
prejudice other applicants who have been waiting longer than he -in some cases, since as long as December, 2002.
While this would
be unfortunate, Defendants failure to fulfill their statutory duty
to other applicants has no bearing on whether they have fulfilled
their statutory duty to Plaintiffs, and thus cannot serve as a
basis for denying Plaintiffs motion.
While Defendants worry that
granting Plaintiffs relief may reward the more litigious
applicants or encourage other applicants to file lawsuits,
perhaps recognizing this possibility will provide the defendants
with adequate incentive to begin processing [I-485] applications in
a lawful and timely fashion in order to obviate the applicants
need to resort to the courts for redress. Dong, 2007 WL 2601107
